Understanding Statutory Declarations: What, Why, and How

At some point in your life, you may need to make a statutory declaration, a legal statement confirming that certain information is true. But why is this necessary? Where do you go to swear one? And how does the process work? Let’s break it down.

Why might you need a statutory declaration?

There are various reasons why you may be required to make a statutory declaration. Sometimes, it’s for personal administrative matters—such as obtaining a replacement degree certificate from your university, even if no legal dispute is involved.

In more formal legal situations, statutory declarations can play a crucial role. For example:

  • Property ownership or the existence of an agreement
  • Declarations related to family arrangements or estate matters
  • Statements in financial dealings or business contracts

Where can you swear a statutory declaration?

A statutory declaration must be sworn in the presence of an independent witness. This means that if it is related to legal matters, you cannot do so before your own solicitor (or anyone from their firm) or the solicitor representing the other party. Instead, you must find a completely independent solicitor to witness the declaration.

In theory, most local solicitors should do this; however, in our experience, solicitors seem less and less willing. This may be because the fees are limited to £5 per document (plus £2 for any ‘exhibits’ – additional documents such as a plan). However, at Boston Spa Legal, we see this as part of the role in our community to assist people (and other local solicitors) when a service is required and we would be delighted to help you out.

How do you swear a declaration?

The first step is to arrange an appointment for you to swear a statutory declaration at our office in Boston Spa. While the process is quick, please call ahead and book a time.

Once at our office, the process is straightforward and quick:

  1. Verify your identity.
  2. Sign the document containing your declaration.
  3. You will be asked to read a short declaration (we provide the wording), affirming that the contents of your declaration are true.
  4. Philip signs as your independent witness.

What should you bring to your appointment?

To ensure a smooth process, please bring:

  • A copy of the declaration, properly completed in advance if necessary.
  • The required fee, which is £5 per document and £2 for each annexure (such as an attached plan). Please bring the exact amount in cash as we don’t keep a cash float.
  • Your identification (ID) to verify your identity. Please bring a driving licence, or a passport with recent address ID.
